This seminar will offer a review of Massachusetts law and practice relating to public and private streets and ways including:  creation, relocation and discontinuance, along with the so-called derelict fee statute and subdivisions.

 

Who Should Attend?
This seminar is designed for the practicing land surveyor, surveyor-in-training, land use planner, real estate attorney and anyone who is interested in keeping abreast of the case law regarding Massachusetts Highway Law. This subject is full of ambiguities that the speaker will help clarify. Attendees will bring valuable information back to their daily practices.

Seminar Speaker:

F. Sydney Smithers, IV, Esq., is a member of the Pittsfield law firm of Cain Hibbard & Myers, PC, where he practices in the areas of real estate development, land use, environmental, zoning, subdivision control, municipal and conveyancing law.  Mr. Smithers is a graduate of the University of Pennsylvania’s Wharton School of Finance and Commerce and Boston University of School of Law and was appointed a Land Court Examiner in 1972.  A former chairman of the Massachusetts Continuing Legal Education Real Estate Curriculum Advisory Committee, he is also former President of the Massachusetts Conveyancers Association, now the Real Estate Bar Association of Massachusetts (REBA).  He serves as a member of the REBA Alternative Dispute Resolution panel.  Mr. Smithers is President of the Abstract Club and a member of the Berkshire Bar Association, the New England Land Title Association, the Massachusetts City Solicitors and Town Counsel Association and is a fellow of the American College of Real Estate Lawyers.  Mr. Smithers is also an honorary member of MALSCE.  Mr. Smithers is a contributing author to Crocker’s Notes on Common Forms (9th ed., MCLE 2006) and numerous other MCLE publications.

* Members of CALS, MSLS, NHLSA, NYSAPLS, RISPLS and VSLS can attend for the MALSCE Member rate, provided they fax or mail their registrations to MALSCE. Registration fee includes lunch and all seminar handouts. Registration is processed on a first-come, first-served basis. MALSCE will give a 50% refund for cancellations made by Monday, May 16, 2011. No refunds will be given after this date. No-shows will be billed.
