FY2013 STATE BUDGET COMPROMISE SIGNED INTO LAW

Gov. Deval Patrick signed the state's budget for Fiscal Year 2013 into law on Sunday, July 8, 2012 and issued some vetoes. This $32.5 billion spending plan  includes provisions to increase funding for local aid and makes some reforms to the state's welfare and immigrant verification systems. The budget directs $5.7 billion in state revenues back to cities and towns for spending at the local level, almost $289 million more than FY2012. It  includes $899 million in unrestricted local aid and $4.17 billion for local school districts. The budget will draw $350 million from the state's rainy day account, leaving roughly $1.2 billion in reserves, and spends the $516 million in one-time revenues, or $120 million less than last year and down from $2 billion in fiscal 2011.

 

The Massachusetts Legislature is reviewing the Governor's vetoes this week and may override some of them in formal sessions starting on July 11.  The formal session of the legislature ends on July 31, 2012.  Any controversial items will be handled or tabled by the end of the formal session.

HOUSE AND SENATE APPROVE $200 MIL CHAPTER 90 BILL – will still work on larger transportation bond bill
On June 27, 2012, the Massachusetts Senate approved a bill that provides $200 million in promised local road and bridge repair funds to cities and towns.  A six-member conference committee agreed to the Chapter 90-only bill, divorcing it from larger, ongoing deliberations over a $1.5 billion transportation bond.   The House originally approved a transportation financing bill limited to the Chapter 90 funds.  The Senate then passed legislation with the local funds as well as funding for statewide projects as part of a $1.5 billion bill requested by Gov. Deval Patrick.  The Chapter 90 bill released from conference committee Wednesday requires that all construction contracts funded under it include a price adjustment clause for fuel, asphalt, concrete; and steel.
Construction Manager/General Contractor (CMGC) To Be Used For MBTA Green Line Extension

Chapter 118 of the Acts of 2012, section 62, signed into law by Governor on June 19, 2012, authorizes the use of the CM/GC project delivery method for the Green Line Extension project.  Chapter 118 is the FY2012 Supplemental Budget for the Commonwealth and includes many other pieces.

TWO YEAR US TRANSPORTATION BILL – Compromise Reached

On June 29, 2012, the US House and Senate voted on a 2 year federal transportation bill, called Moving Ahead for Progress in the 21st Century or MAP-21.  This bill provides $82 billion for highways and $21.3 billion for transit programs over Fiscal Years 2013-2014 and  includes an extension of current funding through September 30, the end of the current fiscal year.  The final package provides funding through September 30, 2014. MAP-21 increases funding for the Transportation Infrastructure Financing and Innovation Act (TIFIA) program to $1.75 billion over two years, to help states leverage funding through loans, loan guarantees and public-private partnerships. The bill consolidates several highway programs to give states more flexibility for allocating funds.  It also streamlines project delivery requirements, including the integration of planning and environmental reviews, pre-NEPA property acquisition, delegation of environmental compliance responsibilities to states, and expansion of categorical exclusions. The bill does not include Keystone pipeline or coal ash regulation. President Obama has been signed the bill into law.
