Updates from Massachusetts Board of Registration of PEs and PLSs - September/October 2016

October 11, 2016 PE and PLS (EN) Board of Registration Committee on Professional Competency (CPC) Meeting 

At this meeting, the Committee on Professional Competency (CPC) discussed potential language related to mandating continuing education for license renewal.  At this point in time, the committee is looking to recommend 18 Professional Development Hours during each biennial registration renewal period to maintain theoretical, technological and business profiency for one's scope of practice, unless exempt under 5.10(7). The Committee also discussed the merits of mandatory continuing education requirements. The CPC plans to present its recommendations to the full Board of Registration at its November 17, 2016 meeting.  


September 22, 2016 PE and PLS (EN) Board of Registration Meeting


 The Board discussed these issues:

  • Update on technical changes to 250 CMR:  The Board had held a public hearing on some technical corrections to 250 CMR.  At this board meeting, the Board voted to direct the Division of Professional Licensure staff to proceed with implementing the changes as proposed.  The changes to 250 CMR will become effective when published by the Secretary of State for the Commonwealth in approximately one month from the date of the vote.  We will notify MALSCE members when these changes become effective.

  • Trade/Design Build Exemption in M.G.L. c. 112, s. 81R(a) (Link)
  • The Board received a letter from an attorney on behalf of a client asking about the exemption. 
  • Update to NCEES Records System: NCEES record holders issue 
  • NCEES, the National Council of Examiners of Engineering and Surveying has implemented a new Records Systems to help its member boards of registration to have one place to check on the license status of applicants applying for comity in other states. The system has had a few glitches that impact the Massachusetts Board of Registration of Professional Engineers and Professional Land Surveyors and other state boards, as the boards need exam discipline, exam results, and where it is taken, on page one of the new summary sheet.  
  • Unfortunately, NCEES's database is not consistently showing disciplines since the vast majority of member boards do not report that information to NCEES. In addition, NCEES is in the final stages of revising the records program with particular respect to individuals who created a Council Record before 2008. They are going to transfer some of the information from their old record (most not of the best quality or as accurate as NCEES would like) to their new record to keep them from having to replicate that information.  NCEES expects to have that up and running very soon.
