This informative discussion explores breaking news and current topics for surveyors. The presentation will include a real estate mediation involving survey issues, led by former Appeals Court Judge and Real Estate Bar Association mediator Rudolph Kass, to address the unique aspects of real estate mediation. In addition, learn about the new lien law for design professionals that Governor Patrick signed into law on January 5, 2011, creating lien rights for land surveyors and engineers.  This program also features an engaging discussion of claims involving access to and use of water bodies, an analysis of leading cases from 2010 relevant to the use of surveys in litigation, and an in-depth discussion of surveyor liability in Massachusetts.

 

The panel will address many topics that will enable you to create more effective surveys, which may help you avoid litigation or prevail on disputed claims.

• understand the amendments to MGL Chapter 254 effective July 1, 2011 creating lien rights for surveyors
• recognize the unique rules regarding tidal areas and other water bodies which date back to colonial times

Mr. Cetlin’s areas of practice include commercial real estate, commercial leasing, real estate financing and general real estate.  He represents buyers, sellers, commercial landlords and tenants, developers and lenders.

 

Denise A. Chicoine, Englander, Leggett & Chicoine PC 

Ms. Chicoine has significant experience litigating disputes involving rights in the intertidal zone and beach access claims, easements, construction disputes, conveyancing, Chapter 91 and zoning matters. 

 

Edward S. Englander, Englander, Leggett & Chicoine PC

Mr. Englander’s expertise includes the Colonial Ordinance of 1641-47 and beach rights, easements, boundary disputes, agricultural preservation restrictions, aquacultural grants, construction disputes, conveyancing, analyzing complex back titles, condominium conversions, and real estate leases.

 

Honorable Rudolph Kass (Retired), The Mediation Group

Judge Kass served as an associate justice of the Massachusetts Appeals Court from 1979 to 2003. During his tenure, he was the author of 1,680 opinions of the court as well as approximately 200 single justice memoranda and orders. In 2003 Judge Kass joined The Mediation where he has been active as both a mediator and an arbitrator. Judge Kass is also an adjunct professor of law at Boston College Law School.

Mr. Mangiaratti serves as City Solicitor for the City of Attleboro and Town Counsel for the Town of Mendon and handles permitting and real estate litigation.
